CITY OF RIO RANCHO PARKS, RECREATION & COMMUNITY SERVICES DEPARTMENT PARTICIPANT WAIVER, RELEASE OF ALL CLAIMS, ASSUMPTION OF RISK, TERMS AND CONDITIONS FOR ALL PROGRAMS/ACTIVITIES

PLEASE READ CAREFULLY and be aware that in signing up and participating in the City of Rio Rancho Parks, Recreation and Community Services Department's (CITY) recreation program/activities, you will be expressly assuming the risk and legal liability and waiving and releasing all claims for injuries, damages or loss which you or your minor child/ward might sustain as a result of participating in any and all activities connected with and associated with the CITY?s programs/activities.

WAIVER AND RELEASE OF CLAIMS:

I recognize and acknowledge that there may be certain risks involved in participating in park programs/activities, and I voluntarily agree to assume the full risk of any injuries, damages or loss, that my minor child/ward or I may sustain as a result of said participation. I further agree to waive and relinquish all claims I or my minor child/ward may have (or accrue to me or my child/ward) as a result of participating in such program/activity against the CITY, including their respective officials, officers, employees, and volunteers (hereinafter collectively referred as ?Parties?). I do hereby fully release and forever discharge the Parties from any and all claims for injuries, damages, or loss that my minor child/ward or I may have or which may accrue to me or my minor child/ward and arising out of, connected with, or in any way associated with these programs/activities. I indemnify and hold harmless the CITY, any of its employees and/or agents from any and all claims from my use of CITY property or participation in any CITY programs. I will further indemnify and ?hold harmless? the CITY, its employees and/or agents from all costs, expenses and liabilities resulting from any claim brought from my child?s/children?s use of CITY property and/or participation in CITY programs to the extent of the CITY?s liability under general law.

PERMISSION TO AUTHORIZE TREATMENT FOR MINORS:

In the event of emergency injury or illness while the participant is attending the recreation activity, I hereby authorize the CITY to consent to medical treatment on behalf of my child. The undersigned, as parent or legal guardian of the child identified on this account, hereby authorizes the CITY and its adult officers, employees and agents into whose care the registered child has been entrusted, to consent to any x-ray, examination, anesthetic, medical or surgical diagnosis or treatment and hospital care to be rendered to said minor under the general or special supervision and upon the advice of a licensed physician or surgeon. It is understood that if time and circumstances reasonably permit, CITY will endeavor, but is not required, to communicate with the parent or guardian prior to consenting to such treatment. The undersigned further agrees to RELEASE, WAIVE, DISCHARGE AND COVENANTS NOT TO SUE the CITY, its employees, officers and agents on behalf of the undersigned, the registered minor and their personal representatives, assigns, heirs, and next of kin for any loss, damage, or claim therefore on account of any injury to the minor associated with any medical care performed or provided with consent given pursuant to this authorization. This authorization to consent to treatment of the minor identified above is given to the CITY in conjunction with any activity or event in which the minor?s care is entrusted to the CITY.

PERMISSION FOR TRANSPORTATION:

Some recreation activities include field trips to parks or public sites. Staff and participants arrive at their destination by either walking or riding on public buses, City buses, 15-passenger vans or other CITY-approved vehicles. I hereby consent to the staff of CITY taking my child on field trips during the recreation activity.

CODE OF CONDUCT AND ETHICS:

I understand that the CITY has the following discipline policy for conduct in recreation programs, sports leagues and facilities. I agree to follow this Code of Conduct. In the event I/my child violate the Code of Conduct and I/my child are asked to leave the program or facility, I understand that the registration/league fee will not be refunded. As a participant or spectator I agree to provide positive support, care, and encouragement for those participating in league/sports by following this Code of Ethics. I will encourage good sportsmanship by demonstrating positive support for all players, coaches, and officials at every game, practice or other youth/adult sports event. I will place the emotional and physical wellbeing of the participants/players ahead of my personal desire to win. I will play or encourage my child to play in a safe and healthy environment. I will support coaches and officials working with my team or my child?s team, in order to encourage a positive and enjoyable experience for all. I will demand a sports environment for myself or my child that is free from drugs, tobacco alcohol, vapor and electronic cigarettes will refrain from their use at all youth sports events. I will remember that the game is for recreational fun. I will do my very best to make sports fun for myself, my teammates or my child and his/her teammates. I will, or I will ask my child to treat other players, coaches, fans and officials with respect regardless of race, sex, creed or ability. I will or I will help my child enjoy the sports experience by doing whatever I can, such as being a respectful fan, assisting with coaching, or providing transportation.

PHOTOGRAPHY:

I hereby consent to the photographing, videotaping, audiotaping by the CITY staff during CITY activities to be used in any or all CITY publications, websites, or broadcasts to the public over radio and television stations. I understand that I will not receive any monetary compensation, now or in the future. I hereby release and hold harmless CITY from any claims that may result from the use of such reproductions.

PROGRAM CANCELLATION AND REFUND POLICY:

CITY reserves the right to cancel any program due to insufficient enrollment. Early registration is encouraged to help prevent course cancellation due to an apparent lack of interest. If a class or program is cancelled, you will be notified and offered an alternative choice, if available. If no alternative is available, a full refund or credit on account (your choice) will be issued within 30 days. CITY also reserves the right to cancel, postpone, combine classes, change rooms, or change instructors as needed.

Cancellation requests and refunds are not available online. If you wish to cancel your class or program enrollment, you must notify the Recreation office at 505-891-5015 or the Aquatics office at 505-891-5230 prior to the class registration deadline. Refunds will be minus a $15.00 administrative fee for process and handling. Refunds are not available after the class has already started. Medical emergencies will be handled on a case-by-case basis. Note: Some activities have a ""No Refund"" policy or a program-specific refund policy. This will be written in the activity description or manual.

TAX INFORMATION:

Tax is included in all fees.

ACKNOWLEDGEMENT:

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above and, for myself, my heirs, assigns, and my minor child(ren)'s involvement or participation in the program as provided above. I have read and fully understand the above important information, warning of risk, assumption of risk, policies, terms and conditions and waiver and release of all claims.

APPLICANT ACCEPTANCE OF RENTAL AGREEMENT & INDEMNITY:

Electronic signature is required. Signature is acknowledgment that applicant has read and understands the waiver, release of all claims, assumption of risk, terms and conditions for all programs and activities.
