TERMS AND CONDITIONS OF PARKER RECREATION FACILITIES MEMBERSHIP

Rules and Regulations: All members agree to abide by the Parker Parks and Recreation facilities' posted rules and Patron Code of Conduct while in the facilities. Facility and activity schedules are subject to change. The Parker Recreation Center and Parker Fieldhouse will close annually for a week-long scheduled maintenance; patrons will be given advanced notice. H2O?Brien Pool will close for the Parker Days event and as of August, will only be open on weekends.

Price Lock Promise on auto-renew, auto-debit Annual memberships: As long as the membership remains active and uninterrupted, rates will not increase on an auto-renew, auto-debit Annual membership. The member must provide payment information for monthly auto-debit payment. The membership will automatically renew upon its expiration date and the member is responsible for all accrued dues and other charges.

Waiver of Claim: The applicant warrants and represents to the Parks and Recreation Department that he/she is in good physical condition, suffering from no condition which would make participation at the center harmful or dangerous. The member hereby waives any right of recovery or cause of action against the Town of Parker, employees, or agents for any injury sustained by the member or for any physical condition created or aggravated by the member's participation in the activities of the Recreation Facility. It is agreed that the Town of Parker Parks and Recreation Department shall not be liable to members, their successors and assigns, for any injuries or any damage to members or be subject to any claim, demand, injury or damages resulting from acts of omission on the part of the Town of Parker, its officers, employees, or agents. The Town of Parker shall not be responsible or liable for property damaged, lost, or stolen in or about Recreation Facilities or lockers.

Severability: In the event any part or parts of this agreement are deemed invalid or unenforceable, such part or parts shall be severed and the remained of agreement shall be in full effect.

The Parker Parks and Recreation Department reserves the right to cancel this agreement at any time it deems that the conduct of the member is detrimental to the Recreation Facility and/or contrary to its regulation. Memberships will be stopped if bank debits are not paid as a result of insufficient funds, closed accounts, stopped payments or credit card declines.

Billing: This authorization will remain in effect until canceled in writing or the pass/membership expires. The member agrees to notify the Town of Parker Parks and Recreation Department in writing of any changes in account information at least 15 days prior to the next billing date. For ACH debits to checking/savings accounts, because these are electronic transactions, these funds may be withdrawn from the account as soon as the noted periodic transaction dates. The origination of ACH transactions to an account must comply with the provisions of U.S. law. In the case of a payment being rejected for non-sufficient funds, closed account, stopped payments or credit card decline, there may be an additional $25.00 charge added to the account.

Cancelations: Member must provide a written cancelation request with documentation. Requests will be reviewed on a case by case basis and may take up to 30 days for review. Cancelation fees may apply. Refunds will not be given on unused passes/memberships.
